Terms and Conditions
The Terms and Conditions set out below apply to all participants submitting entries for the Ola x Ghostbusters giveaway ("Competition/ Promotion"). Please read these terms and conditions carefully. Participation in this Competition will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate. By entering the competition participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding.
The Promoter reserves the right to amend, modify, change, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
1. THE PROMOTION AND PROMOTER:
1.1 The Promoter is Unilever South Africa Proprietary Limited – henceforth referred to as “the Promoter”.
1.2 The Promotion will run from the 1st of April 2024 up to 31st of May 2024 ("the Promotional Period"). No entries received after midnight on the 31st of May 2024 will be accepted. The Promotion Period may be extended or curtailed at the discretion of the Promoter.
1.3 The Promotion is valid while stocks last. The qualifying products are subject to stock availability at the time of purchase and will vary by store.
2. WHO MAY ENTER
2.1 The Promotional competition (Promotion) is open to all South African Residents who are in possession of a valid identity document, except any employee, director, officer, member, partner, agent, consultant, advertising agencies, advisers, dealers, supplier, affiliates and/or associated companies of the Promoter or any person who controls or is controlled, directly or indirectly, by the Promoter and/or immediate family members of the aforesaid people (hereinafter referred to as “Disqualified Persons”).
2.2 All Participants in the Promotion (“Participants”) must, at the time of entering the Promotion:
a) be a natural person and be at least 18 (eighteen) years of age;
b) be a citizen and/or legal resident of the Republic of South Africa;
c) be in possession of a valid South African Identity Document, resident/work permit and/or Driver’s License; and
d) be residing or be present in South Africa for the duration of the Promotional Period and for the period during which the prize draws and the delivery or collection of the prize/s takes place.
2.3 By participating in this competition participants agree to receive future marketing material from the brand/s on promotion. However, the participant has the right to unsubscribe to receiving marketing material or request the promoter to delete their information by contacting the Promoter at 15 Nollsworth Crescent, Nollsworth Park, La Lucia, 4051 Att: Legal Department or opting out from any electronic marketing message.
2.4 All personal information (‘Personal Data’) supplied by participants shall be processed in accordance with South African data protection legislation and the Promoter’s Privacy Policy.
3. HOW TO ENTER
3.1 To enter the competition, Participants must purchase any of the participating products and follow the instructions below:
3.2 Dial USSD number *120*1566*5# from a registered prepaid cell phone number that has been RICA'd and registered in the name of the participant.
3.3 Follow the text prompts to complete their entry. Hereinafter referred to as an "entry".
3.4 USSD entries costs 20c per 20 seconds. Free minutes do not apply. Incomplete entries may be billed by the participant's service provider.
3.5 Proof of purchase (till slip) must be retained in order to stand a chance to win a prize. Consumers who win any of the draw based prizes will also need to produce their tillslips. Tillslips serve as proof of ice-creams being bought, thus, failure to produce the valid till slip will result in selected winners being disqualified.
3.6 Consumers who purchase from the vendor tricycle boxes will need to take a photo with the vendor as proof of purchase as they do not issue till slips.
3.7 Participants may only enter as many times as they’d like, provided that they have a valid proof of purchase(eg till slip) for every purchase within the competition period. Every entry required a unique till slip. Multiple entries made with the same till slip will be disqualified.
3.8 The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
3.9 No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
3.10 Any attempt to use multiple e-mail, cell phone or Facebook accounts or other tactics to enter more than once per till slip may result in disqualification and all associated entries and/or votes will be void.
Entries or votes generated by script, macro, bot, commercial contest subscription, incentives or other means not sponsored by the Promoter, vote-swapping sites, voting software, entering service sites or any other automated means and entries by any means that subvert the entry process or do not conform to the terms or spirit of these competition rules, will void the entry/votes and may disqualify the entrant.

5. SOCIAL PLATFORMS
5.1 The promotional competition is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram, TikTok, or any other social media platform that may be used to promote the competition. Participants acknowledge that they are providing information to the Promoter and its agents only, and not to Facebook, Instagram, TikTok, or any other social media platform.
5.2 Where applicable, participants in this promotional competition release Facebook, Instagram, TikTok, and all other social media platforms of liabilities for and claims arising out of or in connection with participating in, or winning a prize in this promotional competition and these rules.
6. PRIZES
The Promotion will afford participants a chance to receive one of the following prizes:
a. Sony Playstation- PS5 (1 of 3)
b. Ghostbusters Movie hampers (1 of 5)
c. Movie ticket pairs (1 of 30).
Hereinafter collectively referred to as "prizes".
6.1 Winners will accept the prize as is and at their own risk.
6.2 Promotional images are merely a representation of the prize and the actual prize may vary. The Promoter reserves the right to substitute any of the prizes for a different prize of similar value.
6.3 Any risks in relation to the prizes (such as loss, theft or damages) will pass to the winner once the prize has been collected/accepted and/or signed for by the winner. The Promoter will not be responsible for any lost, stolen or damaged prize] and no replacements will be made.
6.4 All participants submitting entries must have their details entered in all the required fields correctly.
6.5 The Promoter reserves the right to change the draw date at any time.
6.6 By entering the promotional competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel the promotional competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deem necessary.
6.7 Entries which are unclear, illegible or contain errors or from disqualified persons will be declared invalid.
7. AWARDING OF PRIZES
7.1 The winner will be selected by means of a random draw and will be notified telephonically or via social media upon which they will be required to verify their details. The organizers will endeavour to contact the prize winners once every day for 5 consecutive working days after their name is drawn. However, if they cannot be reached and do not return the call, the person/s will be disqualified, the prize will be forfeited and another winner will be selected in accordance with the rules.
7.2 Prizes are not transferrable or exchangeable and may be forfeited or be the subject of a separate draw or be allocated to another winner at the Promoters' discretion. The Promoter is not liable for any defect in the prize. The Promoter reserves the right to substitute prize with any other prize of comparable commercial value or the cash equivalent, as determined by the Promoter.
TAXES, LEVIES & DUTY
7.3 If any taxes, levies, duties or any charges whatsoever are levied on a prize by any competent authority outside of the prize package, the winner will be liable for these and the prize value will not be increased to compensate for such charges.
PUBLICITY
7.4 The Promoter reserves the right to use any images taken of the winner for publicity purposes in any manner they deem fit, without any further remuneration being made payable to the winner, and may require the winner to be identified, photographed and published in printed/social media, or to appear on radio and television, when accepting his/her prize and/or after having received his/her prize. However, the winner has the right to object to these images being used and must formally notify the Promoter, in writing, of such objection, after being informed that he/she is the winner.
PRIZE SUBSTITUTION
7.5 In the event that the prize/s are/is not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute prizes of equal value.
INDEMNITY
7.6 All participants and the winners, as the case may be, indemnify the Promoter, its advertising agencies, advisers, nominated agents, suppliers, affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in the promotional competition (including, as a result of any act or omission, whether as a result of gross negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the prize).
7.7 The Promoter assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever.
7.8 The Promoter is not liable for any technical failures affecting the participation and/or prize redemption process of the promotional competition.
7.9 Neither the Promoter nor employee, director, officer, member, partner, agent, consultant, advertising agencies, advisers, dealers, supplier, affiliates and/or associated companies of the Promoter shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant.
7.10 The Promoter will require the winners to complete and submit an information disclosure agreement and indemnification document to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the prize and it shall revert back to the Promoter to select another winner.
8. TERMS OF DELIVERY
8.1 Physical prizes will be delivered to the winner's preferred residential or work address (within major cities) after receiving and verifying all the requested documentation.
8.2 Deliveries will only be made to physical addresses (no postal addresses) where someone is able to sign for the prize on weekdays during working hours. Deliveries to high theft risk / special delivery areas will require an alternative address within a major city/town or the winner will be able to collect the prize from the supplier’s nearest branch. Similarly, if the winners cannot supply an address within a major city covered by delivery or be unavailable to sign for the prize during working hours, the winner will be requested to collect the prize from the suppliers nearest branch.
Any risks in relation to the prizes will pass to the winner once delivered regardless of who has signed for the parcel at the specified address.
8.3 The Promoter is not responsible for any undelivered prizes due to any incorrect details being provided by the winner with regards to their preferred delivery address or being unavailable to sign for their prize. The Promoter will not be responsible for any lost, stolen or damaged prizes once the prize has been signed for. The courier may allow someone other than the consignee present at the delivery address to sign for the prize delivery if the consignee is unavailable or unreachable – it is therefore the winner's responsibility to ensure they provide a safe low risk address/destination for delivery.
8.4 Winners may be required to sign Indemnities and/or Consent Forms when accepting their prize.
8.5 The Promoter reserves the right to carry out reasonable due diligence to confirm eligibility and may refuse to award the prize to a participant if there is suspicion of any irregularities or fraudulent activities.
8.6 Digital vouchers will be delivered by email or SMS notification.

9.2 The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Promotion and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonable deems necessary.
9.3 The onus rests on the participants to check the website for updates to the Terms and Conditions.
